Billable Exclusions
Any and all exclusions (including but not limited to image-editing beyond scope, annual web hosting fees, annual domain name registration and/or renewal fees, additional concepts or color versioning beyond scope), project work or project services performed or conducted outside of the agreed-upon project scope are billable at an hourly rate of $50 or as otherwise noted in this agreement. All expenses are billed at a 10% markup.

Project Cancellation
In the event of cancellation of a project during its execution or rejection of a completed project, ownership of all copyrights, the original artwork and project elements completed to that date shall be returned to Creating Websites That Work and/or Hummingbird Creative Concepts.  Deposit will in turn be forfeited and all additional labor and expenses beyond the original deposit amount will be billed at the hourly rate of $75/hr.  Any usage by the Client of those design elements will result in appropriate legal action.  Client shall bear all costs, expenses, and reasonable attorney’s fees in any action brought to recover payment under this contract or in which the designer may become a party by reason of this contract.

The Planting the Seeds For Success Mentoring Program:

As stated on the registration page for this program, all registrations are final for the Planting the Seeds For Success Mentoring Program.

If you choose a payment plan to pay for your registration in the Planting the Seeds For Success Mentoring Program, you agree to pay the registration fee in full as per terms of that payment plan as listed in your mentoring agreement for the program.

If you choose a payment plan to pay for your registration, and your credit or debit card is declined for any reason for any of the payments, you will immediately use another form of payment upon notification of the decline, or you will forfeit your placement in the program until payment is made.

If you choose to remove or cancel yourself from this program prior to the end of the program dates, you understand that refunds will not be issued, and if you’ve chosen to pay your registration fee via the installment plan, that you are still responsible for paying your balance in full.

Complimentary sessions are offered as a service to potential clients.  They provide strategic insight for you and your business as well as provide an opportunity for us to determine if we would be a good fit for working together in the future.  I expect my clients to be committed to their business growth and honor commitments they make to themselves and to the work we are doing.  For this reason if you are a no show or miss our complimentary session without notifying me, we probably won’t be a good fit for each other and you will not be allowed to schedule another complimentary session in the future.

So how does this affect you?

Well, if you currently offer an affiliate program and you have affiliates promoting your products within the state of California, then this law essentially means that you are now recognized as having a physical presence in the state.  By having a physical presence in the state, you may now be saddled with sales tax responsibilities to that state.

I am certainly not a tax expert, but as an online marketing strategist, I understand the importance of affiliate marketing and what it can mean to your bottom line.  When I saw this video article on Jessica Matthews’ “Bite of Brilliance” I knew I needed to pass along the information to my peeps.

If you currently have an affiliate program or are thinking of implementing one, I strongly recommend that you check in with your Accountant or Tax Specialist ASAP to ensure that the terms of your currently affiliate program do not cause you additional tax liabilities.

In other words, DO NOT UPGRADE until you confirm that your hosting account meets the new requirements listed below.

With this upgrade, your hosting account will be required to be running the following:

• PHP 5.2.4 or greater (BEFORE this Upgrade the requirement was PHP 4.3 or greater)
• MySQL 5.0.15 or greater (BEFORE this Upgrade the requirement was MySQL 4.1.2 or greater)

The easiest way to ensure that your hosting company is up to date and running the PHP and MySQL at the minimum requirements for this latest version of WordPress 3.2 is to install the WordPress Plugin – Health Check plugin and it do the heavy lifting for you!

The plugin is designed to check your current hosting and will immediately let you know via message in your dashboard if your are good to go or not.  If the plugin warns you that your hosting is not compatible, DO NOT PERFORM THE 3.2 upgrade until your host gets up to date with their own upgrades!  

As you know, keeping up to date with the latest WordPress updates keeps your website safe from possible security threats, so it is important that you upgrade to this latest version of WordPress 3.2, but not before ensuring that your hosting accounts meet these new requirements. 

If you try to upgrade without meeting these two requirements first, it WILL crash your site.

The path to converting website visitors into paying clients begins with building a relationship with them.  Building a relationship requires you to have a way to connect with them even after they’ve left your site.  This is why having an effective opt-in box and collecting email addresses of visitors on your site is critical to your online success.

You’d be surprised how many service based business owners either aren’t doing this at all or are only doing it on one or two pages of their website.

Here are the basics of capturing email addresses of visitors to build your list:

• Choose an eMail or eCommerce provider for managing your list
• Develop an information packed free give away that showcases your expertise -(YES, you need a free give away, your newsletter is not enough to entice the majority of visitors to sign up to your list.)
• Set up your eMail or eCommerce provider to automatically deliver your free give away when someone opt’s into your list**
• Offer your free give away in exchange for your visitor’s name and email address on your website via your opt in box
• Watch your list grow and client relationships bloom!

Once you begin building your list, it is important to communicate with them on a regular basis via your eNewsletter.  This regular communication builds trust and builds relationships.
